Toro Ag Irrigation Limited Product Warranty Summary Description The Toro Company warrants to Toro Ag trade customers that it will repair or replace, at its option, any Toro® brand ag product below (each a “Product”), when used for agriculture, that has a defect in materials or workmanship during the applicable warranty period. This warranty covers the cost of replacement Product only. The warranty does not cover labor incurred or charged by any person or entity, including but not limited to labor costs incurred by a grower to install, reinstall, or repair a Product, or to mitigate effects on crops during periods when the Product is not functioning as expected or otherwise not in use. If only a portion of a product is defective, The Toro Company may elect to repair or replace only the defective portion, rather than the entire product. This warranty applies only if you comply with the terms and conditions herein, the Instructions for Installation, Maintenance and Use that accompany that product, and the instructions in the Toro Ag Owner’s Manual.(available at driptips.toro.com). Items and Conditions Not Covered • Failure of, or loss or damage to, anything other than the Product, including products not manufactured by The Toro Company even if they are sold by The Toro Company and/or used in conjunction with Toro® Products • Loss or damage to the Product caused by anything other than a defect in materials or workmanship • Use for non-agricultural purposes • Claims that occur outside the warranty period or are otherwise not in compliance with the requirements specified in this warranty • Loss or damage occurring during shipment. • Damage or deterioration due to normal use, wear and tear, or accident. • Cost of regular maintenance service or parts, such filters • Damage resulting from service by anyone other than Toro Ag or its authorized service dealers • Any Product or part which has been altered, mishandled, misused, or abused • Non-standard use, including but not limited to damage caused by using machinery to move the irrigation system; continuous pressure situations; or the use of heated water, wastewater, or potable water (Product is not made to be used with drinking water) • Use in temperatures exceeding 105 degrees Fahrenheit • Any Product which has not been properly installed, used, or maintained in accordance with the Toro Ag Owner’s Manual • Damage caused by: negligent or otherwise improper installation, maintenance, or use; insects, rodents or animals; mechanical damage; plugging; over-pressurization • Environmental stress cracking (ESC) and other forms of material degradation caused by weather, outside influences, or substances injected into or through the Product • Any repairs necessary due to use of parts, accessories, chemicals or other supplies which degrade, are incompatible with, or are otherwise contrary to written instructions for use of, the Products Instructions for Obtaining Warranty Service Under this warranty, the sole remedy is to direct all claims to an authorized Toro Ag dealer. 1. Within 5 days of discovering a Product defect, contact the dealer from whom you obtained the Product to submit a warranty claim. 2. Provide the Product (or for dripline, drip tape, or hose a sample section of the Product) to the dealer for return to Toro for analysis. 3. Within 30 days of submitting your warranty claim, provide The Toro Company and its representatives with access to the field(s) where the allegedly defective Product has been used, system components, design information, maintenance records, and information on the substances distributed through the Products (including fertilizers, chemicals, etc.). Failure to provide such access invalidates this warranty. 4. Retain all Product which is the subject of a warranty claim until the claim has been completely resolved. Types of Losses Not Covered; General Conditions The Toro Company’s sole liability with respect to this warranty shall be repair or replacement of defective Products as set forth herein. In no event shall The Toro Company be liable for any indirect, incidental or consequential damage or loss. Examples of the types of damages that are not covered under this warranty include, but are not limited to: • Labor incurred by any person or entity, including but not limited to labor to remove, reinstall, splice together, or dispose of Product • Costs to remediate fields or otherwise address periods of over- or under-watering • Any claims for indirect, incidental, consequential, or special damages. • Lost revenue, lost profit, crop damage or loss, vegetation loss, reduced yields, or any other costs incurred as a result of periods of failure or non-use of a Product • Attorney's fees. The Toro Company makes no other warranties regarding the Products. We expressly disclaim all implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Some states do not allow exclusions of incidental or consequential damages, or limitations on how long an implied warranty lasts, so the above exclusions and limitations may not apply to you.
